ALBANY, N.Y. (AP) — A state legislator has filed a court brief supporting the federal lawsuit aimed at overturning New York’s new gun restrictions.
Sen. Kathy Marchione, (mahr-SHEE’-ohn-ee) a Saratoga Republican, is asking a judge for permission to join the court record supporting the state affiliate of the National Rifle Association, sportsmen’s groups and others.
They say the statute enacted Jan. 15 violates Second Amendment rights.
The law, pushed by Gov. Andrew Cuomo, followed the Dec. 14 Connecticut school massacre.
It tightens the definition of “assault weapons” to include some popular semi-automatic rifles, banning new sales and requiring registration of older guns.
Marchione, who voted against it and gathered 130,000 online petition signatures for repeal, says those provisions contradict U.S. Supreme Court rulings and won’t withstand judicial scrutiny.
State lawyers say the constitutional claims have no merit.
